La obligación del numeral 5 de este artículo, debemos entenderla en el marco de lo ordenado por la Ley 1116 de 2006 que regula el proceso de reorganización y el proceso de liquidación judicial. Que fue complementada por la Ley 2437 de 2024, con el proceso de reorganización abreviado, la liquidación simplificada y un nuevo procedimiento de recuperación empresarial ante las cámaras de comercio. Y con lo indicado en la ley 2445 de 2025, sobre la insolvencia de personas naturales comerciantes con activos totales inferiores a mil (1.000) SMMLV. Normas todas que buscan atender la situación de los comerciantes que se encuentren en apuros para responder por sus obligaciones.
